This document forms part of the binding legal framework for the Beg.com Platform. Please read it carefully. Continued use of our services constitutes acceptance of these terms as updated from time to time.
1. Parties and acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and beg Inc., together with its affiliates (collectively, "beg," "we," "us," or "our"), governing access to and use of the beg crowdfunding and fundraising technology platform, including our websites, applications, APIs, and related services (the "Platform").
By creating an account, launching or managing a campaign, making a donation, requesting a payout, or otherwise accessing the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Notice, Cookie Policy, Fees, Refunds & Campaign Review Policy, and other policies referenced herein. If you do not agree, you must not use the Platform.
2. Nature of the Platform
beg provides a technology marketplace that enables individuals and organisations worldwide to create time-bound fundraising campaigns and receive voluntary contributions from supporters. beg is a platform operator and technology service provider. Unless expressly stated otherwise:
- beg is not a bank, payment institution, broker-dealer, investment adviser, insurer, or charity;
- beg does not underwrite, guarantee, or insure campaign outcomes or the conduct of organisers;
- beg does not provide financial, tax, accounting, or legal advice;
- donations are voluntary contributions and are generally not investments or equity interests.
3. Eligibility and account integrity
You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction (whichever is higher), and have legal capacity to enter binding contracts. If you use the Platform on behalf of an organisation, you represent that you are authorised to bind that organisation.
You agree to provide accurate registration information, maintain the confidentiality of your credentials and security PIN, and promptly notify us of unauthorised access. You are responsible for all activity under your account.
4. Campaigns, review, rejection, and organiser obligations
Campaign organisers ("Organisers") agree that:
- all campaigns are subject to review and may be approved, rejected, suspended, or removed at beg's reasonable discretion;
- campaign content must be accurate, lawful, non-misleading, and kept reasonably up to date;
- funds raised must be used for the stated purpose, or material changes must be disclosed to supporters;
- Organisers are solely responsible for compliance with local fundraising, charity, tax, and consumer laws;
- Organisers may be required to complete identity, sanctions, or anti-fraud verification before payout;
- campaigns are time-bound (maximum 30 days unless Platform settings provide otherwise).
4.1 Rejection before going live
If a campaign is rejected before it accepts donations, no fundraising balance is created for that campaign. beg will notify the Organiser where practical, including a reason when available. The Organiser may revise and resubmit unless the rejection is final for legal or safety reasons.
4.2 Suspension or rejection after donations
If a live campaign is suspended or rejected, new donations may be disabled, visibility may be limited, and withdrawals are blocked while the matter is reviewed. Funds still under beg's control may be held, refunded to donors where appropriate, or handled as required by law or payment partners. Organisers are not entitled to withdraw funds from a rejected or suspended campaign unless beg reinstates the campaign or expressly authorises a release. Further detail is in our Fees, Refunds & Campaign Review Policy.
5. Donations and payments
Donations are voluntary and, except where mandatory consumer or payment-network rules require otherwise, are generally non-refundable once successfully processed. Payment processing is performed by independent third-party providers (including, where configured, Stripe, Polar, or PayPal) under their own terms and privacy practices.
Limited refund or payment-review cases (duplicate payment, confirmed fraud while funds remain available, or mandatory network rules) are described in the Fees, Refunds & Campaign Review Policy. Chargebacks may reverse donations and can result in holds on organiser balances.
6. Platform fees
Creating a campaign is free. beg charges a platform fee of 10% on each organiser withdrawal (payout) of raised funds. The fee is deducted from the withdrawal amount at the time of the payout request. Payment processors and banks may charge separate fees. The live rate is shown in the payout interface and may be updated with notice; the rate in force when a payout is requested applies to that request.
7. Payouts and compliance holds
Organisers may request withdrawal of available balances subject to Platform rules, fee deductions, campaign end conditions, verification, and compliance screening. beg reserves the right to delay, withhold, reverse, or refuse payouts where we reasonably suspect fraud, prohibited use, chargebacks, sanctions exposure, money laundering, or material Terms violations, or where required by law or our payment partners. Rejected or suspended campaigns are not withdrawable until resolved.
8. Prohibited uses
You shall not use the Platform to, or in connection with:
- illegal activity, fraud, money laundering, terrorist financing, or sanctions evasion;
- hate, violence, exploitation of minors, or content that infringes third-party rights;
- impersonation, misrepresentation of affiliation, or deceptive fundraising;
- circumvention of fees, security controls, or payment systems;
- unauthorised scraping, reverse engineering, malware, or interference with Platform integrity.
9. Intellectual property and licence
beg and its licensors own all rights in the Platform, branding, software, and documentation. Organisers retain ownership of campaign content they submit, and grant beg a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and promote such content in connection with operating and marketing the Platform.
10. User content and communications
You are solely responsible for content you publish. beg may remove or restrict content that violates these Terms or applicable law, without prior notice where reasonably necessary to protect users, the Platform, or third parties.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. beg DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, NOR DOES beg ENDORSE ANY CAMPAIGN OR GUARANTEE ORGANISER PERFORMANCE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, beg SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. beg’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU TO beg IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD 100).
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or fraud.
13. Indemnity
You agree to indemnify and hold harmless beg and its officers, directors, employees, and agents from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your campaigns or donations, your content, or your breach of these Terms or applicable law.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to conflict-of-law principles. Except where prohibited by mandatory local law, disputes shall be resolved by binding individual arbitration administered in English. You waive any right to participate in class or representative proceedings to the extent permitted by law.
Consumers in the European Economic Area, United Kingdom, or other jurisdictions with mandatory consumer protections may also have rights to bring claims in their local courts, which remain unaffected where required by law.
15. International use
The Platform is offered globally. You are responsible for compliance with local laws applicable to your activities. We may restrict access in certain jurisdictions to comply with sanctions, export controls, or regulatory requirements.
16. Changes and termination
We may modify these Terms by posting an updated version with a revised effective date. Material changes may be communicated through the Platform or by email where appropriate. Continued use after the effective date constitutes acceptance. We may suspend or terminate access for breach, risk, or legal reasons.
